Who we are
Nestor (‘we’ or ‘us’ or ‘our’) gather and process your personal information in accordance with this privacy notice and in compliance with the relevant data protection Regulation and law. Nestor act as the data controller and data processor. This notice provides you with the necessary information regarding your rights and obligations, and explains how, why and when we collect and process your personal data.

Nestor is a trading style of Nestor Financial Group Ltd. Nestor’s registered office is at Controlled House, Waterfold Business Park, Rochdale Road, Bury, BL9 7BR. We are registered on the Information Commissioner’s Office Register of Data Controllers under registration number Z365309X. Information that we collect
The primary legal basis that we intend to use for the processing of your data is for your legitimate interests, however in situations where we need your consent we will not process your data without such consent.

We need to obtain personal information about you so that we can provide the information, financial services and financial advice that you have requested. Our services include financial planning and personal injury services (including welfare benefits advice and personal injury trusts). We will never collect any unnecessary personal data from you and do not process your information in any way, other than already specified in this notice.

We will normally obtain personal information directly from you in a face to face meeting but it may also be obtained by telephone, post or other means. In some instances we may receive your personal data from your legal representative but this is subject to your agreement with them to provide us with that information.

The information that we request will generally include your personal and financial information and, where relevant, information about your health, if it is necessary for the provision of our services. Categories of personal data will include the following:

For financial advice we analyse your current and future financial needs so that we can ensure that any advice takes due account of, and is suitable for, your circumstances. Your personal information will also be used for the ongoing administration and management of any products or policies that Nestor advises on.

We will not share your information with any other party except as indicated in this Privacy Notice or where required to do so by any statutory, governmental or regulatory body for legitimate purposes.

We keep your information securely for as long as we need to for the purpose of providing you with information, financial services and financial advice or for as long as we are required to by relevant regulations and legal obligations. Where you have received financial advice, Nestor will retain all client information indefinitely due to the regulatory requirements of the Financial Conduct Authority (FCA) and the legal risks associated with the provision of financial advice.

Your rights
You have the right to access any personal information that Nestor processes about you and to request information about:

  • What personal data we hold about you
  • The purposes of the processing
  • The categories of personal data concerned
  • The recipients to whom the personal data has/will be disclosed
  • How long we intend to store your personal data for
  • If we did not collect the data directly from you, information about the source.

If you believe that we hold any incomplete or inaccurate data about you, you have the right to ask us to correct and/or complete the information and we will strive to update/correct it as quickly as possible; unless there is a valid reason for not doing so, at which point you will be notified.

You also have the right to request erasure of your personal data or to restrict processing in accordance with data protection laws, as well as to object to the processing of your personal data.

Please note however as FCA regulated advisers we are required to retain records relevant to our advice to you and this can supersede your right to have all data deleted under the General Data Protection Regulation.

If we receive a request from you to exercise any of the above rights, we will ask you to verify your identity before acting on the relevant request; this is to ensure that your data is protected and kept secure.

We do not share or disclose any of your personal information without your consent, other than for the purposes specified in this notice or where there is a legal requirement.
